General Terms and Conditions for Researchdata.se

1. Introduction and acceptance of Terms

By accessing or using Researchdata.se (“the Service”), you accept these Terms and Conditions (“Terms”) and agree that they govern your use of the Service. You warrant that you are authorized to enter and fully perform these Terms and Conditions and agree to be bound by them. These Terms constitute a legally binding agreement between you and Swedish National Data Service (“SND,” “we,” “us,” or “our”).

We may update these Terms from time to time, when necessary, for example due to legal or regulatory requirements, changes in applicable law, new or modified functionality, or improvements to the Service. The current version of the Terms is always made available on the Service and applies at the time of use. As we do not require user registration and may not be able to notify users individually of changes, it is your responsibility to review the Terms each time you access or use the Service. Continued use of the Service constitutes acceptance of the Terms in force at that time. The latest update of these Terms was on 2026-02-06.

The laws of Sweden shall govern this agreement and your use of the Service. Your use of the Service may also be subject to other local, national, or international laws.

2. Definitions

For clarity throughout this document, the following terms have specific meanings:

  • Service: the Researchdata.se websites, including their sub domains, the Researchdata.se applications and all available services, functions, and capabilities on these applications;
  • User: any individual or entity who accesses or uses the Services;
  • Access request: a request from a User for permission to access restricted files;
  • Dataset: the data files and accompanying documentation that are accessible via Researchdata.se by direct download or upon access request. Records where only metadata have been harvested into Researchdata.se are not included in this definition;
  • Metadata records: descriptions of data for which metadata have been automatically harvested into Researchdata.se;
  • Terms and conditions (“Terms”): these Terms and Conditions for users.

3. Service operator

Researchdata.se is a collaboration between universities, research infrastructures, and organisations across Sweden (Collaboration partners) to promote interdisciplinary collaboration and sustainable data management. The Service is operated by the Swedish National Data Service (SND), a national research infrastructure at the University of Gothenburg.

The Service is offered subject to acceptance without modification of the Terms contained herein.

4. Accessing and using Datasets and metadata

Datasets are accessible directly through the Service or, in the case of access restrictions, by requesting access through an access request form. Data from metadata records are accessible via their original source/portal.

You must comply with the licences or marks on the Dataset and any access restrictions pertaining to each Dataset you access or use.

You will promptly notify SND of any breaches of confidentiality, privacy or data protection, licensing, or intellectual property issues regarding Datasets that you become aware of.

5. Use of information and training materials

The information and training materials provided on Researchdata.se are intended as general recommendations and are made available as is, without any guarantees or warranties regarding their completeness, accuracy, or suitability for any particular purpose. SND disclaims liability and responsibility for how the information is used or interpreted.

Users are advised to consider and comply with any applicable local rules, regulations, or institutional policies that may apply to their specific context or jurisdiction.

You must comply with the licences and marks on the material, as described on the Licences and marks page.

6. Limitation on use of the Service

While using the Service, you shall not, nor permit others to, upload, download, post, submit or otherwise distribute or facilitate distribution of any information that

  1. infringes intellectual property rights, including patents, copyrights, know -how, trademarks and trade secrets, or other rights, including privacy rights, of any third party;
  2. is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, obscene, offensive, or profane;
  3. constitutes unauthorised or unsolicited advertising, junk, or bulk e-mail (“spamming”);
  4. contains software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware, or telecommunications equipment or to damage or obtain unauthorised access to any system, data, or other information of SND or any third party.

In addition, you accept

  1. not to bypass any measures that are used to prevent or restrict access to the Service and other accounts or computer systems connected to the Service;
  2. to fully comply with the General Data Protection Regulation (EU) 2016/679 when the Dataset contains personal data.

7. Modification or Termination of the Service

SND reserves the right to modify, suspend, or terminate the Service, in whole or in part, at any time, without liability, except where required by mandatory law.

8. Liability

Your use of the Service or Datasets provided on Researchdata.se is at your own risk. The Service is provided as is, without warranties of any kind, neither expressed nor implied. SND is not liable for any direct or indirect damage resulting from your use of the Service, unless caused by SND’s intent or gross negligence.

You agree to indemnify and hold SND harmless from any damage and costs, including reasonable attorneys’ fees and court costs, arising from (i) your violation of these Terms, (ii) your user content (Datasets), or (iii) your use of the Service.
